1. Coaching Services
1.1 Coaching Only Meetings and Bundles
1.1.1 General Terms and Conditions
1.1.1.1 Coaching meetings are single-purchase services that are sold in 1, 4 or 8 meeting bundles.
1.1.1.2 Coaching meetings are limited to a maximum of 45 minutes. Please ensure that you log into the waiting room 5-minutes before the scheduled start time.
1.1.1.3 Payment for a set of coaching meetings will be deducted immediately upon purchase from your chosen credit card or bank account.
1.1.1.4 Additional time or meetings will be at an additional charge.
1.1.1.5 If you are more than 15 minutes late or you fail to attend the scheduled meeting, you forfeit the meeting at full cost.
1.1.1.6 Changes to meeting times must be coordinated with the coach with a minimum of 48 business hours notice.
1.1.1.7 If your regular Coach is unavailable, Real Estate Dynamics will endeavour to appoint another coach or reschedule the session.
1.1.1.8 Real Estate Dynamics reserves the right to cancel the coaching service at any time. A refund for the remaining meetings will be provided.
1.1.1.9 Meetings do not run between the third week of December to the second week or January inclusive.
1.1.1.10 Real Estate Dynamics is the owner of all intellectual property rights and copyright relating to:
i. the Services (including but not limited all calculations and documents associated with the Services);
ii. all designs, drawings, technical information and documents created, owned or held by Real Estate Dynamics; and
iii. the content of any website owned or paid for by Real Estate Dynamics, remain the property of Real Estate Dynamics.
iv. You must not link or transmit any documents owned by Real Estate Dynamics to a third party without the express consent of Real Estate Dynamics.
1.1.2 Special Conditions for Members
1.1.2.1 Discounted rates for Coaching services are only available to employees of the Registered Agency that holds the active Membership.
1.2 BDM Performance Coaching
1.2.1 General Terms and Conditions
1.2.1.1 BDM Performance Coaching is an invitation-only service, provided to those who achieve exceptional results in the BDM Performance Program. Selection is at the discretion of the trainer.
1.2.1.2 BDM Performance Coaching meetings are limited to a maximum of 45 minutes. Please ensure that you log into the waiting room 5-minutes before the scheduled start time.
1.2.1.3 If you require further BDM Performance Coaching time or additional meetings, please discuss with your Coach.
1.2.1.4 Payments are made in advance and first payment will be deducted immediately upon purchase and the recurring fortnightly instalment deducted from your chosen credit card or bank account.
1.2.1.5 The services provided are limited to the services listed in this document. Any additional services requested will be at an additional charge.
1.2.1.6 If an instalment payment is dishonoured, your attendance will be suspended and will recommence once the next instalment is received.
1.2.1.7 There is no lock-in contract, and you can cancel at any time with 7-days’ notice in writing.
1.2.1.8 There are no refunds for missed meetings and you forfeit the meeting at full cost.
1.2.1.9 No transfers to other individuals are permitted.
1.2.1.10 The list of topics in the meeting agenda are cyclical but may be subject to change at the coach’s discretion.
1.2.1.11 This is a standalone service and does not grant access or discounts to any other product or service.
1.2.1.12 If your regular Coach is unavailable, Real Estate Dynamics will endeavour to appoint another coach or reschedule the session.
1.2.1.13 Real Estate Dynamics reserves to cancel the BDM Performance Coaching service at any time.
1.2.1.14 Attendees agree that their log-in details and the BDM Performance Coaching content cannot be shared. Sharing of this information may lead to cancellation of enrolment and forfeit of amount paid.
1.2.1.15 Attendees who are disruptive, use inappropriate language or display general bad behaviour will be removed from the course and the amount paid is forfeited.
1.2.1.16 All attendees are prohibited from sharing other attendees personal information.
1.2.1.17 Meetings do not run between the third week of December to the second week or January inclusive.
1.2.1.18 Real Estate Dynamics is the owner of all intellectual property rights and copyright relating to:
i. the Services (including but not limited all calculations and documents associated with the Services);
ii. all designs, drawings, technical information and documents created, owned or held by Real Estate Dynamics; and
iii. the content of any website owned or paid for by Real Estate Dynamics, remain the property of Real Estate Dynamics.
iv. You must not link or transmit any documents owned by Real Estate Dynamics to a third party without the express consent of Real Estate Dynamics.
2. Consulting Services
2.1 Foundation
2.1.1 General Terms and Conditions
2.1.1.1 Foundation is a single-purchase service consisting of 12 consultant-led meetings with supported content.
2.1.1.2 Foundation meetings are limited to a maximum of 45 minutes. Please ensure that you log into the waiting room 5-minutes before the scheduled start time.
2.1.1.3 Payment for Foundation will be deducted immediately upon purchase from your chosen credit card via our website.
2.1.1.4 Changes to meeting times must be coordinated with the Consultant with a minimum of 48 business hours’ notice.
2.1.1.5 If you are more than 15 minutes late or fail to attend the scheduled meeting, you forfeit the meeting at full cost.
2.1.1.6 Additional time or meetings will be at an additional charge.
2.1.1.7 If your regular Consultant is unavailable, Real Estate Dynamics will endeavour to appoint another Consultant or reschedule the meeting.
2.1.1.8 Real Estate Dynamics reserves the right to cancel the consulting service at any time. A refund for the remaining meetings will be provided on a pro-rata basis.
2.1.1.9 Meetings do not run between the third week of December to the second week or January inclusive.
2.1.1.10 Real Estate Dynamics is the owner of all intellectual property rights and copyright relating to:
i. the Services (including but not limited all calculations and documents associated with the Services);
ii. all designs, drawings, technical information and documents created, owned or held by Real Estate Dynamics; and
iii. the content of any website owned or paid for by Real Estate Dynamics, remain the property of Real Estate Dynamics.
iv. You must not link or transmit any documents owned by Real Estate Dynamics to a third party without the express consent of Real Estate Dynamics.
2.2 Consulting Only Subscription
2.2.1 General Terms and Conditions
2.2.1.1 Consulting Only subscriptions are billed monthly from the date of purchase.
2.2.1.2 Consulting appointments are for 1 hour. Meetings run for approx. 45 minutes with time for follow-up and communication actions post-meeting. Extensions to the meeting time is at the discretion, schedule and availability of the Consultant.
2.2.1.3 Changes to set appointment times require 48 hours’ notice from the client to cancel or change the time, otherwise, the session is forfeited.
2.2.1.4 Consulting Only Subscription appointments do not run between the third week of December to the second week of January inclusive.
i. No billing will occur in January for Bi-Monthly Consulting Only clients
ii. Billing continues as normal for monthly Consulting Only clients, but meeting dates may vary in December and January.
2.2.1.5 Appointments and payments may be paused by the client at any time with 2 business days notice. Pausing of subscription can be co-ordinated with the Consultant.
2.2.1.6 Subscription cancellation by the client requires notice in writing via email to the Consultant at any time with a period of 2 business days’ notice.
2.2.1.7 Real Estate Dynamics may cancel the subscription and/or appointments at any time.
2.2.1.8 Real Estate Dynamics is the owner of all intellectual property rights and copyright relating to:
i. the Services (including but not limited all calculations and documents associated with the Services);
ii. all designs, drawings, technical information and documents created, owned or held by Real Estate Dynamics; and
iii. the content of any website owned or paid for by Real Estate Dynamics, remain the property of Real Estate Dynamics.
iv. You must not link or transmit any documents owned by Real Estate Dynamics to a third party without the express consent of Real Estate Dynamics.

2.3.2 Special Conditions for Members
2.3.2.1 Discounted rates for Consulting services are only available to employees of the Registered Agency that holds the active Membership.
2.4 Diagnostic Audit Report
2.4.1 General Terms and Conditions
2.4.1.1 Diagnostic Audit Reports collect data on Agency operations, Personnel and Financial information.
2.4.1.2 All data gathered is stored in a secure data warehouse and used for bench-marking purposes.
2.4.1.3 Please refer to Data Collection Statement for further terms and conditions that relate to this service.
2.4.1.4 This service is delivered remotely online, unless otherwise specified.
2.4.1.5 Purchase of a Diagnostic Audit Report is for one (1) Real Estate office with an ABN, operating no more than one (1) trust account and with up to 25 staff. This service is not for multiple offices, ABN’s or multiple reporting periods.
2.4.1.6 Any other related expenses as agreed by the customer are to be paid by the customer using their nominated credit card.
2.4.1.7 Payment will be made at these two stages:
i. 50% of total cost is due upon commencement of Diagnostic Audit Report.
ii. Final 50% is due prior to delivery of the report.
2.4.1.8 Real Estate Dynamics will take every effort to ensure accuracy and verification of data points, however does not guarantee the accuracy of the data supplied. All information and advice supplied throughout the Diagnostic Audit process is general in nature and not to be considered as financial, accounting or legal advice. Real Estate Dynamics are not liable for any outcomes from decisions made using the information contained in this report.
2.4.2 Special Conditions for Members
2.4.2.1 Accelerated and Accelerated Plus Members are eligible for one (1) complimentary Diagnostic Audit Report per 12-months. If the customer does not wish to complete a Diagnostic Audit Report within the 12-month period, this report is forfeited for the period and does not accrue. There are no refunds or credits available in lieu of the service.
2.5 E-DISC and Behaviour Profiling
2.5.1 General Terms and Conditions
2.5.1.1 Payment will be deducted immediately upon purchase.
2.5.1.2 No refunds or split payments.
2.5.1.3 All EDISC reports are pre-purchased. Once an order is received, one code is allocated, and credit is used to access the survey. Once the credit is used there are no refunds or changes.
2.5.1.4 The EDISC report forms part of the recruitment selection process and will not be sent to the candidate.
2.5.1.5 Privacy of reports is the responsibility of the purchasing agency.
2.5.1.6 EDISC Behavioural Profile Report and the BDM Recruitment and Hiring Kit do not guarantee the success of the individual’s performance within the role, the resource is to be used as a guide in the selection process and potential development of an individual.
2.6 Knowledge Resource Library and Support Hub
2.6.1 General Terms and Conditions
2.6.1.1 Each user requires their own login and users agree that their log-in details cannot be shared with others.
2.6.1.2 Content within the Resource Library and Support Hub cannot be shared with any external individuals or agencies. Sharing of this information may lead to suspension of your access.
2.6.1.3 Agencies are required to keep their users up to date and advise Real Estate Dynamics of any staff changes that may impact their users.
2.6.1.4 Support can be provided through the Live Chat, via email or phone call.
2.6.1.5 The information, advice, materials and services contained on this platform are provided to the user “as is” and “as available”. Real Estate Dynamics does not warrant or guarantee the currency, accuracy, adequacy or completeness of this information and materials, and expressly disclaim liability of any errors or omissions in this information or materials.
2.6.1.6 The contents do not constitute legal advice and should not be relied upon as such. Formal legal advice should be sought in particular matters.

2.6.1.12 Real Estate Dynamics shall not be liable for any failure to access or delayed access. If such access is prevented, hindered or delayed by reason of any cause beyond the reasonable control of the Real Estate Dynamics, including without limitation, any third party, any labour dispute, strike or other industrial disturbance, Act of God, flood, shortage of materials, earthquake, casualty, war, act of the public enemy, terrorism, data corruption, internet interruption, telephony services interruption, riot, insurrection, embargo, law, blockage, action, restriction and regulation or order of any government, government agency or division thereof.
2.6.1.13 Knowledge may contain links to third party sites. We are not responsible for the content of any linked site or any link contained in a linked site.
